In its most recent argument, Holmes‘ defense team cited her “two very young children” as evidence that she is not a flight risk and should remain free while she appeals her fraud conviction.
She has close relationships with family and friends, many of whom submitted letters at sentencing attesting to her good character, and she volunteers with a rape crisis and counseling organization, according to the court filing.
The 39-year-old woman’s second pregnancy was disclosed in earlier court documents. In July 2021, Holmes gave birth to her first child with her fiance Billy Evans.
Holmes is determined to delay the start of her 11-plus year sentence, which is scheduled to begin on April 27.
The former CEO of Theranos, who dropped out of Stanford University, was convicted of defrauding investors of more than $144 million in 2017.
At one point, the company’s valuation reached $10 billion due to Holmes’ claims that her startup could run tests on a small amount of blood to detect serious medical conditions. These claims proved to be a gross exaggeration of Theranos’ capabilities.
According to a November court filing, Northern District of California Judge Edward Davila recommended Holmes serve out her sentence at the Federal Prison Camp in Bryan, Texas.
According to its website, the minimum-security women’s facility located approximately 100 miles northwest of Houston houses approximately 540 female inmates across four dormitory units on a 37-acre campus.
The “camp” is more conducive than other prisons to family visits. Davila stated in his sentencing that “family visitation enhances rehabilitation”

According to Business Insider, a new document requesting Elizabeth’s sentence start date be delayed until the conclusion of her appeal process appeared to reveal that she and Billy had recently welcomed a child. The report identified the ex-founder as the mother of “two young children.”
There is no additional information available regarding her second child. Elizabeth and Billy have not confirmed the birth of their child.
